Lynkr ("we", "us", or "our") operates the Lynkr mobile application and the website at www.lynkr.me (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree to these Terms, do not use the Services.

1. Eligibility

a. Age Requirement

You must be at least 13 years old to use Lynkr. By using the Services, you represent and warrant that you meet this age requirement.

b. Minor Users

If you are between 13 and 18 years of age, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

a. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any suspected unauthorised access.

b. Accurate Information

You agree to provide accurate, current, and complete information when creating your account and to keep it up to date.

c. Account Security

Lynkr is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

3. Acceptable Use

a. Prohibited Content

You agree not to post, share, or link to content that is:

Unlawful, harmful, threatening, abusive, harassing, or defamatory.

•

Obscene, pornographic, sexually explicit, or adult (18+) in nature.

•

Linking to or promoting illegal activities, substances, or services.

•

Invasive of another person's privacy.

•

Infringing on any third-party intellectual property rights.

b. Prohibited Actions

You agree not to:

Impersonate any person or entity or misrepresent your affiliation with any person or entity.

•

Upload or transmit viruses, malware, or any other malicious code.

•

Collect or harvest personal data of other users without their consent.

•

Use the Services for spam, phishing, or unauthorised commercial communications.

•

Attempt to gain unauthorised access to any part of the Services or related systems.

•

Violate any applicable laws or regulations.

c. Enforcement

We reserve the right to remove any content and to suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.

4. User Content

a. Ownership

You retain ownership of all content you upload or create on Lynkr ("User Content"). By posting User Content, you grant Lynkr a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely for the purpose of operating and improving the Services.

b. Your Responsibility

You are solely responsible for your User Content. You represent and warrant that your User Content does not infringe any third-party intellectual property rights and complies with all applicable laws.

c. Public Visibility

Your profile page, including the links and content you add, is public by default and accessible to anyone with your profile URL. You control what content appears on your profile.

5. Intellectual Property

a. Lynkr Property

The Lynkr name, logo, app design, themes, and all related intellectual property are owned by Lynkr and protected by applicable intellectual property laws.

b. Restrictions

You may not copy, modify, distribute, reverse-engineer, or create derivative works from our intellectual property without our prior written consent.

6. Links and Third-Party Content

a. Your Links

Lynkr allows you to display links to third-party websites and services on your profile. You are responsible for all links you add and agree not to link to any content that violates these Terms.

b. No Endorsement

We are not responsible for the content, privacy practices, accuracy, or availability of any third-party sites or services that you or others link to.

7. Analytics

Lynkr collects anonymised analytics data about profile views and link clicks to provide you with usage statistics and to improve the Services. This data is described in detail in our Privacy Policy. By using the Services, you consent to this data collection as described.

8. Service Availability

a. Uptime

We strive to keep Lynkr available at all times, but we do not guarantee uninterrupted or error-free access.

b. Modifications

We may suspend, modify, or discontinue the Services (or any part of them) at any time, with or without notice. We are not liable for any loss or damage arising from any such interruption or discontinuation.

9. Account Termination

a. By You

You may delete your Lynkr account at any time:

In the app: Go to Profile → My Account → Delete Account. Your account and all associated data will be permanently removed immediately.

By email: Alternatively, send a request to support@lynkr.me with the subject "Account Deletion Request". We will process your request within 30 days.

b. By Lynkr

We may suspend or terminate your access to the Services at any time, for any reason, including if we believe you have violated these Terms.

c. Effect of Termination

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LYNKR DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE OF ERRORS OR VIRUSES.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LYNKR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR $10.

12. Indemnification

You agree to indemnify and hold harmless Lynkr, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms.

13. Governing Law and Disputes

a. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

b. Dispute Resolution

Any dispute arising from these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. When we do, we will revise the "Effective date" at the top of this page. For material changes, we will notify you by email or via an in-app notice. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. If you disagree with the changes, you may request account deletion before they take effect.
